Individuals can do a broad variety of things with their words and enjoy different degrees of this capacity. What moderates this capacity? And in cases in which this capacity is unjustly disrupted, what is a good explanation for it? These are the questions I address here. I propose that speech capacity, understood as the capacity to do things with your words, is a structural property importantly dependent on individuals' position in a social structure. My account facilitates a non-individualistic explanation of (...) cases in which speech capacity is undermined due to speaker's perceived social identity, e.g. episodes of silencing. Instead of appealing to interlocutors' implicit bias against speaker's identity, a structural approach refers to the positions interlocutors occupy in the social structure and the discursive conventions operating upon those positions. I articulate my proposal drawing on the notion of affordances. Each position within a social structure is associated with its own range of speech affordances. Thus, speech capacity is a function of the probability distribution of speech affordances across positions in the structure. (shrink)

Background The use of lengthy, detailed, and complex informed consent forms is of paramount concern in biomedical research as it may not truly promote the rights and interests of research participants. The extent of information in ICFs has been the subject of debates for decades; however, no clear guidance is given. Thus, the objective of this study was to determine the perspectives of research participants about the type and extent of information they need when they are invited to participate in (...) biomedical research. Methods This multi-center, cross-sectional, descriptive survey was conducted at 54 study sites in seven Asia-Pacific countries. A modified Likert-scale questionnaire was used to determine the importance of each element in the ICF among research participants of a biomedical study, with an anchored rating scale from 1 to 5. Results Of the 2484 questionnaires distributed, 2113 were returned. The majority of respondents considered most elements required in the ICF to be ‘moderately important’ to ‘very important’ for their decision making. Major foreseeable risk, direct benefit, and common adverse effects of the intervention were considered to be of most concerned elements in the ICF. Conclusions Research participants would like to be informed of the ICF elements required by ethical guidelines and regulations; however, the importance of each element varied, e.g., risk and benefit associated with research participants were considered to be more important than the general nature or technical details of research. Using a participant-oriented approach by providing more details of the participant-interested elements while avoiding unnecessarily lengthy details of other less important elements would enhance the quality of the ICF. Stakeholder Theory combines the pursuance of business goals and responsibility toward a firm's stakeholders. Despite the wealth of research on Stakeholder Orientation, we still have much to learn about specific measurements for several related constructs. In this study, we draw on two samples of 129 and 151 Spanish firms, respectively, to investigate CEOs' perceptions on Stakeholder Integration (SI), leading to the identification of three dimensions of the construct. In this respect, our study suggests that Knowledge of Stakeholders, Interactions between a (...) firm and its stakeholders, and the adaptation of a firm's behavior to stakeholders' demands constitute the main dimensions of SI. This construct has the potential to connect the stakeholder and strategy literatures. (shrink)

We propose an externalist understanding of sex that builds upon extended and distributed approaches to cognition, and contributes to building a more just, diversity-sensitive society. Current sex categorization practices according to the female/male dichotomy are not only inaccurate and incoherent, but they also ground moral and political pressures that harm and oppress people. We argue that a new understanding of sex is due, an understanding that would acknowledge the variability and, most important, the flexibility of sex properties, as well as (...) the moral and political meaning of sex categorization. We propose an externalist account of sex, elaborating on extended and distributed approaches to cognition that capitalize on the natural capacity of organisms to couple with environmental resources. We introduce the notion of extended sex, and argue that properties relevant for sex categorization are neither exclusively internal to the individual skin, nor fixed. Finally, we spell out the potential of extended sex to support an active defense of diversity and an intervention against sex-based discrimination. (shrink)

Background Healthcare professionals, especially professional nurses, experience various types of moral suffering due to inevitable ethical conflicts. Moral resilience is recently proposed as a resource to address moral suffering. However, there is no tool to measure moral resilience in Chinese professional nurses. Aim This study aimed to translate the Rushton Moral Resilience Scale (RMRS) into Chinese and evaluate the psychometric properties of the Chinese version of RMRS (Chi-RMRS). Research design A methodological and descriptive research design. Participants and research context A (...) convenience sample of 411 Chinese professional nurses was recruited through an online survey platform between February and March 2023. Ethical considerations This study was approved by the Research Ethics Committees of the University and hospitals involved. Results The RMRS was translated and culturally adapted into a Chinese version. Neither floor nor ceiling effects were observed. The scale-level content validity index (CVI) was 0.922 with the item-level CVIs ranging from 0.833 to 1.000. The explanatory factor analysis (EFA) generated a three-factor structure for the Chi-RMRS, and the confirmatory factor analysis (CFA) demonstrated the three-factor structure with factor loadings for each item ranging from 0.42 to 0.80. The scale-level Cronbach’s α coefficient was 0.811 with each dimension ranging from 0.717 to 0.821, and composite reliability (CR) coefficient for the overall scale was 0.920, with each dimension varying from 0.739 to 0.824. The standard error of measurement (SEM) and smallest detectable change (SDC) were 3.522 and 9.763, respectively. Discussion The Chi-RMRS is able to measure moral resilience of Chinese professional nurses, and has good validity and reliability. It can be used in research and practice to determine the level of moral resilience, thus helping nursing managers to monitor the status of Chinese professional nurses, then develop interventions to maintain the well-being of professional nurses and to ensure quality of care. Se asume que diálogo e ironía son experiencia radical en una continua exigencia de reflexión como una manera de habitar la extrañeza y, simultáneamente, bajo el ejercicio pedagógico del ser y hacer de las prácticas educativas. Finalmente se considera al cuidado de sí e innovación educativa como: reflexión y vida en ejercicio. This paper builds upon Mary Kate McGowan’s analysis of the mechanisms of harm in conversations (McGowan 2004; 2009). McGowan describes how a speaker’s intervention might constitute harm by enacting what is permissible to do in the conversation thereafter. We expand McGowan’s analysis in two ways: first, we use her account to argue for the potential of interlocutor’s silence, not only speaker’s intervention, to enact harm; second, we introduce a new party into the picture: observers of the conversation. We propose that (...) not only interlocutors who contribute to harm through action, but also those who do so by omission are morally responsible for that harm. We focus on one aspect of conversations: introduction of presuppositions. We argue that when the presupposition is morally problematic (e.g., sexist, ableist, racist, homo-, trans- or xeno-phobic), interlocutors have a moral responsibility to block it. This responsibility comes in degrees, and, importantly, depends on whether the interlocutor’s speech capacity is diminished by the harmful presupposition (i.e. whether the interlocutor is being silenced). Unlike common approaches to harm in speech, which take the unit of analysis to be the speaker-interlocutor relationship, we take as unit of analysis the relationship between the pair speaker-interlocutor and an observer. Problematic presuppositions introduced in conversations can harm observers overhearing these conversations (as well society as a whole), and prevention of such harm motivates our proposal for attribution of responsibility to interlocutors. We proceed as follows. First we review the dynamics of presupposition introduction. Second, we briefly introduce McGowan’s analysis of conversational pragmatics, subscribing to her account that some conversational moves constitute a special type of harm related to oppression, and outline a taxonomy of the pathways through which harm can be inflicted upon observers and the society as a whole. In the third part we articulate our argument that in the cases of presupposition introduction considered here, interlocutors are not merely allowing harm, but actively doing it, and put forward our proposal for responsibility attribution. Finally, we address potential objections, and situate our proposal within a broader project to fight oppressive speech. (shrink)

Previous studies have explored the impact of magic tricks on different basic cognitive processes yet there is a need of examining effectiveness of a cognitive training program through magic tricks for children with attention deficit hyperactivity disorder. The present study examines the effectiveness and feasibility of the MAGNITIVE program, a manualized intervention for cognitive training through the learning of magic tricks. A total of 11 children with ADHD participated in separated groups of two different community settings, and were assessed at (...) pre-treatment, post-treatment, and a 3-month later follow-up in different tasks involving processing speed, sustained attention, selective attention, and mental flexibility. Using non parametric statistical analyses and Reliable Change Index, the results showed that these children receiving MAGNITIVE particularly improved their performance in sustained attention, shifting attention, and mental flexibility, changes were also observed in processing speed performance yet further research is needed in terms of selective attention and inhibition, given the great individual differences within this sample. Changes were maintained when the program was finished. In terms of viability, the study proved a good treatment integrity in different contexts, adherence to the curriculum, and high levels of engagement satisfaction. In this second clinical trial, MAGNITIVE program appears to be a feasible training program for children with ADHD, as an alternative for medication when possible. (shrink)

Empathy is an emotional response that may facilitate prosocial behavior and inhibit aggression by increasing empathic concern for others. But the vicarious experience of other’s feelings may also turn into personal distress when the person has poor regulation skills and holds stigmatizing beliefs. In thinking about the processes that may trigger the experience of personal distress or empathic concern, research on the influence of psychological flexibility and inflexibility on stigma is showing promising results. Both processes are assessed with the Acceptance (...) and Action Questionnaire–Stigma. The current study sought to carry out a validity study of a Spanish version of the AAQ-S with a sample of adolescents aged 11–17 years. The study included an expanded test of its predictive validity with measures at three times to evaluate the role of psychological flexibility and inflexibility as risk or protective variables for the development of personal distress and/or empathic concern in the stigmatizer. Statistical analyses confirmed a two-correlated-factor solution, the adequate reliability of both factors, and their construct and predictive validity in the expected direction. The stigmatizer’s inflexible reaction to their stigmatizing thoughts predicted the occurrence of personal distress, whereas the stigmatizer’s flexible reaction to their stigmatizing thoughts predicted the occurrence of empathic concern for others. These findings confirm the importance of considering the role of regulatory skills in the experience of empathic concern or personal distress in the presence of stigmatizing thoughts, with possible implications for the promotion of prosocial behavior and the reduction of aggressive behavior among adolescents. The COVID‐19 pandemic triggered an unprecedented health crisis that impacted healthcare systems worldwide. This study explores how Spanish healthcare workers learned, internalised and integrated values and work behaviours during the COVID‐19 pandemic and their impact on the personal sphere. This documentary research, using images, narratives and audiovisual content, was framed within the interpretative hermeneutic paradigm. Categories and subcategories emerged after a final theoretical sampling that focused on the analysis. Data triangulation between researchers favoured theoretical saturation. A total of 117 images (...) and 27 texts were selected. The analysis identified three stages: bewilderment, seeking functionality in the chaos and integrating chaos into care. The data reflects how the need for security and knowledge, and the exhaustion and frustration caused by the initial working conditions, prompted adaptive responses. These responses involved focusing on problem‐solving and strengthening group sentiments and solidarity. Subsequently, the data indicates the acceptance of new structural, organisational and communication aspects. The findings of the analysis will contribute towards finding a framework that can help understand community health crisis events. (shrink)

Is there a choice in sexual orientation? [Wilkerson, William S. : “Is It a Choice? Sexual Orientation as Interpretation”. In: Journal of Social Philosophy 40. No. 1, p. 97–116] argues that sexual desires require interpretation in order to be fully constituted, and therefore sexual orientation is at least partially constituted by choice. [Díaz-León, Esa : “Sexual Orientation as Interpretation? Sexual Desires, Concepts, and Choice”; In: Journal of Social Ontology] critically assesses Wilkerson’s argument, concluding that we still lack a good argument (...) for the claim that choice plays a role in sexual orientation. Here I examine Díaz-León’s response to Wilkerson. I introduce what I call the conceptual act theory of sexual orientation, and argue that even if interpretation were not necessary to constitute sexual desires, it is a necessary element to constitute what we call sexual orientation. However, I conclude that even if we agree that interpretation is involved in sexual orientation, it does not follow that there is a choice involved. (shrink)

Corporate, Social, Ethical and Environmental Reporting should ideally discharge the accountability of an organisation to its stakeholders. Voluntary reporting has been characterised by a dearth of neutral and objective information such that the advocates of SEER recommend that it be made compulsory. Their underlying rationale is that legally specified disclosure requirements and enforcement mechanisms will enhance the quality of such reporting. This paper sets out to explore how realistic this scenario actually is, in view of the conflicting interpretations in the (...) literature on this subject. To that end, a survey of the reporting patterns of 78 of the largest Spanish companies between 2001 and 2003 examines the extent of their compliance with the ICAC-2002 standard, which obliged them to make environmental disclosures in their financial statements. The results suggest that progressive and improved regulation could increase the volume and quality of SEER disclosures. They also suggest, however, that persistent non-compliance means that the problems associated with voluntary disclosure still exist. Finally, through an impression management perspective, the study reveals, the diverse strategies, ranging from dismissal to concealment, that are employed by companies to avoid transparency. As regulation improves and enforcement expectations rise, it becomes more difficult to dismiss compulsory reporting norms. As a result, some firms engage in more complex concealment strategies to attain corporate legitimacy, depriving stakeholders of regulatory information. The latter point serves to reconcile apparently contradictory explanations in the literature as to whether legitimacy theory might explain partial compliance with SEER regulation. (shrink)

Una de las características de la función jurisdiccional, como potestad-poder del Estado, es la interpretación del ordenamiento jurídico y aplicarlo a la resolución de un caso concreto; es decir, el juez, al momento de impartir justicia, deberá realizar un análisis de la norma jurídica que pretende aplicar para dotarla de un sentido concreto y práctico. Es por ello que se puede afirmar que la interpretación judicial cumple una función innovadora del derecho, ya que el juez con éstas al dictar sentencia, (...) puede modificar el ordenamiento jurídico. El presente trabajo tiene como fin exponer que, por vía jurisprudencial, la Sala Constitucional del Tribunal Supremo de Justicia consideró necesaria la creación de un recurso autónomo de interpretación de normas constitucionales, lo cual trajo como consecuencia inmediata, la desestabilización de nuestro estado de derecho. This work aims to show that the Constitutional Division of the Supreme Court of Justice deemed necessary to create, by means of jurisprudence, an autonomous recourse of constitutional norm interpretation, which nevertheless has no legal grip whatsoever. A las conmemoraciones que hacen los hispanistas de acontecimientos y personalidades del 98, será preciso añadir en los sucesivos el recuerdo del hispanista filósofo francés Alain Guy (La Rochelle 1918 - Narbonne 1998), porque este eminente profesor de Historia de la Filosofía Española e Iberoamericana en la Universidad de Toulouse-le-Mirail, ha dedicado intensamente su vida docente y su actividad investigadora a difundir el conocimiento de los filósofos españoles de todos los tiempos y a suscitar la investigación sobre los mismos.

La función de la educación es difundir las ventajas de vivir en sociedades democráticas, sin embargo, la diáspora de esas ventajas está articulada a intereses políticos y económicos globalizados; su misión: anestesiar a la sociedad para que observe en silencio el desmantelamiento de su proyecto de vida. La educación tradicional no fomenta la habilidad para leer la complejidad de esa realidad democrática. Se enfoca, principalmente, en aleccionar sobre las “ventajas” de la modernidad, donde la mayoría tiene como destino ser masas (...) de asalariados y una minoría, “heredar” la élite. Este documento, propone que para leer esta realidad, la ciudadanía debe ser alfabetizada más allá de la mera técnica que sólo sirva para leer, memorizar y escribir manuales; particularmente la alfabetización debe ser: reflexiva, crítica, basada en el diálogo de saberes y permanente; pero, éticamente coordinada por docentes intelectuales. We deal with situations incongruent with our automatic response tendencies much better right after having done so on a previous trial than after having reacted to a congruent trial. The nature of the mechanisms responsible for these sequential congruency effects is currently a hot topic of debate. According to the conflict monitoring model these effects depend on the adjustment of control triggered by the detection of conflict on the preceding situation. We tested whether these conflict monitoring processes can operate implicitly (...) in an implicit learning procedure, modulating the expression of knowledge of which participants are not aware. We reanalyze recently published data, and present an experiment with a probabilistic sequence learning procedure, both showing consistent effects of implicit sequence learning. Despite being implicit, the expression of learning was reduced or completely eliminated right after trials incongruent with the learned sequence, thus showing that sequential congruency effects can be obtained even when the source of congruency itself remains implicit. Frente a problemas de decisión colectiva de cierta complejidad, distintos métodos de votación pueden considerarse igualmente democráticos. Ante esta situación, argumento que es posible investigar cuáles de esos métodos producen mejores resultados epistémicos sobre asuntos fácticos. Comienzo ilustrando la relación entre democracia y métodos de votación con un sencillo ejemplo. Muestro cómo el uso de modelos idealizados permite descubrir algunas propiedades de los métodos de votación; varios de estos descubrimientos muestran que, frente a problemas de cierta complejidad, no hay una (...) respuesta clara acerca de cuál es el resultado de una elección democrática. Frente a esto, sugiero que deberíamos tomar en cuenta un rasgo epistémico instrumental de varios métodos de votación: su capacidad para generar respuestas correctas ante varias situaciones. Esta intuición ofrece lecciones importantes para el diseño de instituciones electorales. (shrink)

In contrast to individualistic explanations of social injustice that appeal to implicit attitudes, structural explanations are unintuitive: they appeal to entities that lack clear ontological status, and the explanatory mechanism is similarly unclear. This makes structural explanations unappealing. The present work proposes a structural explanation of one type of injustice that happens in conversations, discursive injustice. This proposal meets two goals. First, it satisfactorily accounts for the specific features of this particular kind of injustice; and second, it articulates a structural (...) explanation that overcomes their unattractiveness. The main idea is that discursive injustice is not the result of biased interlocutors, but of problematic discursive norms. (shrink)

La reflexión en materia penal ha sido centrada, específicamente, en ciertos discursos considerados “oficiales”, entre los que se consideran los pensamientos ilustrados. Desde ahí arrancan las concepciones modernas acerca del sistema penal europeo, y en gran parte, las legislaciones actuales sobre la materia en el mundo occidental. Sin embargo, no todo el pensamiento penal tiene por canónicas las consideraciones penales ilustradas ni las concepciones clásicas sobre el derecho penal. El presente artículo tiene por finalidad exponer un pensamiento crítico del sistema (...) penal europeo, tanto de sus raíces iluministas, como de su herencia en las sociedades occidentales contemporáneas. Este pensamiento es el del filósofo y psicólogo francés Michel Foucault. Las críticas, interpretaciones y sospechas que el autor arroja, bien pueden ser consideradas en el hoy, sobre todo si pensamos en la resurrección desde la década del 80 y 90 del siglo pasado, de concepciones que hacen resurgir los modelos ilustrados que en el derecho penal se han producido, reconociéndose la escuela del derecho penal mínimo como su máxima tributaria. Esto de algún modo ha incidido a su vez en el pensamiento penal en Chile y su derecho. (shrink)

Il est devenu banal de déclarer que les images virtuelles et le mondes fictifs crées par les nouvelles technologies donnent à repenser le rapport de l'homme au réel, et le rapport de l'homme à lui-même. Il conviendrait aujourd'hui de regarder les oeuvres d'art comme des dispositifs fictionnels, non pas seulement comme de pures et simples fictions, mais comme des virtualités qui aiguisent nos yeux, affûtent nos oreilles, engendrent les fantasmes que nous projetons dans le futur comme autant d'espoirs d'émancipation.

Julián Sanz del Río, fundador del movimiento filosófico del krausismo español, evolucionó políticamente desde el liberalismo moderado al progresista entre 1844 y 1854. Sus amigos moderados desconocían esta circunstancia, y se prestaron a ayudarlo, hasta que una recensión de dos libros franceses publicada en la Gaceta de Madrid, denunciada primero por la prensa tradicionalista por heterodoxia, y luego por los Obispos de Barcelona y Zamora, permitió conocer su verdaderos planteamientos políticos y su anticlericalismo.

Los cuidados paliativos buscan ofrecer una atención holística para brindar una mejor calidad de vida a los enfermos, especialmente cuando se aproximan al fin de su existencia. Profundizar en la dimensión espiritual de la persona humana resulta atractivo puesto que ofrece respuestas al sentido de la vida. Se ha constatado que la atención espiritual aporta grandes beneficios para el paciente. Es por eso que en este trabajo hemos querido profundizar en la importancia de la dimensión espiritual en los cuidados paliativos; (...) se destaca la actitud de la escucha como pieza clave de dicha atención espiritual, lo que evidencia que el burnout de los médicos es el principal obstáculo para potenciar la escucha como una adecuada disposición que resulte consoladora y sanadora. This paper brings feminist public health ethics and feminist analytic tools to bear on mainstream medical research. Specifically, it uses these approaches to call attention to several problems associated with “The Placenta Harbors a Unique Microbiome,” a recent study published in Science Translational Medicine. If homo sapiens, understood as the evolution of the current human being, was characterized by a cerebral advance and a much more evolved communicative capacity than its ancestors, then it is not conceivable that the origin of writing as the maximum exponent of homo sapiens’need for communication did not improve until many thousands of years later. The fact that the first linguistic system perfected and agreed upon by an entire society dates from 3,500 years ago does not prove that this (...) is the origin of writing. Writing, as the origin of the word itself indicates (both in Spanish and English), implies an attempt to communicate in writing and does not require a sophisticated and mature language with a developed grammar, phonetics, or semantics. No matter how rough, clumsy, crude, sparse, scanty, and incomprehensible these early written manifestations may have been, they are samples of writing. Taking into account this starting point, which is not new, the present study suggests a new classification of the origin of writing up to the present day. As long as no more ancient writing endeavors appear, the first attempts at written communication date back to about 40,000 years ago. From then until now, three periods have developed from the linguistic point of view: proto-writing, emergent writing, and maturity. These periods match the cognitive development of human beings with respect to their historical achievements of globalization. (shrink)

En este contexto se sitúa el presente escrito. Se pretende describir el estado de una problemática antigua y nueva. Antigua, porque se remonta a los cimientos mismos de la filosofía y del pensar humano, varios miles de años antes de Cristo. Nueva, porque no han terminado en el siglo XX las discusiones sobre dicha problemática, ni las aplicaciones posibles que se derivan de ella. Se trata del principio de identidad. El presente trabajo partirá de la definición del principio de identidad (...) según Aristóteles. Se matizarán algunos aspectos de tal principio según otros autores que han perseguido sobre todo fines didácticos al presentarlo, ya sea para el desarrollo de la teología como para el de la epistemología o la metafísica. Finalmente, se expondrá —de una manera bastante elemental— la utilización y las conclusiones que algunos autores contemporáneos han efectuado con relación a la identidad. The current COVID-19 crisis may have an impact on the mental health of professionals working on the frontline, especially healthcare workers due to the increase of occupational psychosocial risks, such as emotional exhaustion and secondary traumatic stress. This study explored job demands and resources during the COVID-19 crisis in predicting emotional exhaustion and STS among health professionals. The present study is a descriptive and correlational cross-sectional design, conducted in different hospitals and health centers in Spain. The sample consisted of 221 (...) health professionals with direct involvement in treating COVID-19. An online survey was created and distributed nationwide from March 20 to April 15 which assessed: sociodemographic and occupational data, fear of contagion, contact with death/suffering, lack of material and human protection resources, challenge, emotional exhaustion, and STS. Descriptive findings show high levels of workload, contact with death/suffering, lack of MHPR and challenge, and are moderately high for fear of contagion, emotional exhaustion, and STS. We found an indirect significant effect of lack of MHPR on predicting emotional exhaustion through the workload and on STS through fear of contagion, contact with death/suffering, and workload. To conclude, this study examines the immediate consequences of the crisis on health professionals' well-being in Spain, emphasizing the job demands related to COVID-19 that health professionals are facing, and the resources available in these health contexts. These findings may boost follow-up of this crisis among health professionals to prevent them from long-term consequences. (shrink)

Plurality implies a public sphere in which different worldviews (e.g. Secular Humanist, Christian, Jewish, Muslim and others) coexist respecting each other. Banning the presence of one or several of them from the public sphere is questionable in principle, and divisive in practice.

Se analiza la incorporación del espacio a las dinámicas centrales de los procesos políticos y económicos en el último cuarto del siglo XX en España, a través de su relación con las sucesivas crisis, principalmente reconocidas por su componente económico. Se ha apostado por la producción de espacio (transformación y crecimiento) como respuesta o salida a la crisis fordista, cuestión que finalmente se ha convertido en un componente principal dentro de la actual crisis de financiarización. Se toma como ejemplo el (...) caso de Madrid por resultar paradigmático, ya que la región ha desempeñado un papel como laboratorio de nuevas formas de gobierno y planificación que han dado un mayor protagonismo al espacio, principalmente por el apoyo al crecimiento físico, como motor de crecimiento económico y de competitividad de la región metropolitana en el concierto europeo y mundial de ciudades.
